A claim can be made for injuries sustained and also any out-of-pocket expenses that have been incurred as a result of an accident or injury caused by somebody else. The usual out-of-pocket expenses claimed include travelling expenses, cost of painkillers, cost of replacement clothing, loss of earnings, care etc. It is essential that you keep a list of all the expenses incurred including receipts for items purchased.

This does not necessarily mean that you will not be able to claim any compensation, but it might mean that your compensation will be reduced to some extent. However, it is vital that you contact us so that we can discuss the matter and advise you properly.

There are strict time limits involved in bringing a personal injury claim, the most common being that court proceedings must be issued within 3 years of the date of the accident, or alternatively, if the injured party is a child, 3 years from the date of that child’s 18th birthday.  But there are exceptions. For example, a claim against the Motor Insurers Bureau (MIB) must be submitted within 3 years, regardless of age, and a claim for compensation to the Criminal Injuries Compensation Authority (CICA) must be submitted within 2 years from the date of the assault.  In some circumstances, the time limits may be extended, for example if you can prove that you are under a disability in accordance with the Mental Health Act 2005, but the safest course of action would be to contact a Solicitor as soon as possible, to avoid any problems caused by breaching time limits.

The amount of compensation you will receive will depend on the extent and type of injury sustained. Medical evidence will be required to prove your injuries and it is therefore essential that you visit your GP and/or hospital as soon as possible following the accident. You should also take photographs of your injuries if possible. Once medical evidence is received, we will be able to advise you as to the potential value of your claim.

Recently, a new system has been introduced dealing with Road Traffic Act claims, but this can only be used in limited circumstances. Unfortunately, some claims can take months or years to be finalised, depending on the circumstances of the accident, whether the person at fault admits that is the case, and the injuries sustained. This is why you must contact us as soon as possible. Sometimes, an accident can cause financial hardship, for example lost earnings as a result of not being able to work, and in those circumstances, we are able to obtain a small proportion of money at an earlier stage in the claim, prior to settlement, to try and ease any financial difficulties.
