Angela Killa, Director in the Family team at JCP Solicitors, explains Divorce Day – and shares how couples seeking a divorce can do so in a constructive and child-focused manner.

The first Monday of January has become known as ‘Divorce Day’, as it is one of the most common days of the year for couples to consult a Solicitor for divorce advice.

Although the Christmas and New Year holiday period is often a joyful time for many, for others it can be the final straw when dealing with a strained relationship.

Heightened stress caused by financial pressures and spending increased amounts of time as a family can push couples to the brink, and many couples find they are entering the New Year ready to start a new chapter apart.

For those with children, waiting until January to start proceedings tends to be preferable, so as not to cause upset over the Christmas period.

As members of Resolution – a community of family justice professionals – we take a constructive approach to divorce and encourage families to get take a child-focused approach to their separation. We understand how emotional the divorce process can be, and we offer individualised support to encourage families to remain as amicable as they can.

For couples with children, it is important that the divorce process is approached constructively: ideally, couples will manage child arrangements without getting a Solicitor involved, basing decisions on what will be in the child’s best interests.

However, we understand that this is not always possible. If resolution cannot be reached without legal involvement, JCP Solicitors can support with legal advice and guidance tailored to your individual circumstances. We will encourage you to prioritise your child’s wellbeing, ensuring that you get the best outcome for your whole family.

If you are looking to start divorce proceedings in 2025, JCP Solicitors can help. Contact the Family Law team on 03333 208644 or email law@jcpsolicitors.co.uk.
