Confidential Info and Know How

An often forgotten about element of intellectual property is confidential information / trade secrets. The value of confidential information is often in its secrecy.  Once the cat has been let out of the bag the information cannot be made secret again.  Therefore, it is often said that there are only really two remedies for confidential information / trade secrets: injunctions; and damages.

Because this is the case, we advise all our clients to carefully consider how they recognise their confidential information and to think about how they are going to protect it – both through internal policies and contracts.
