Brain Injury Compensation Claims
A serious head injury will invariably have a life-changing impact on the survivor and those around them. Money cannot alter that but compensation can help to make life post-injury just that little bit easier for you and your family.
Our expert team at JCP have experience assisting our clients with acquired brain injury caused in a wide range of tragic circumstances. These include accidents at work, road traffic accidents, slips and falls and medical negligence.
Embarking on a damages claim is daunting but our experienced acquired brain injury lawyers are here to take the strain during this difficult time.
Many people have legal expenses insurance cover (often associated with household insurance) but if this is not available we can look at “no win/no fee” funding for you. For most types of litigation cost is an obstacle but for personal injury claims it is not and it should not be your first concern.
An initial consultation is free and you are under no obligation to instruct us or to proceed with a claim. In a catastrophic injury claim we may work with you for many years and therefore personal relationships are all important. It is crucial that you are comfortable with JCP and with our lawyers.

How acquired brain injury claims work
In order to succeed in a claim for compensation arising from an acquired brain injury it must be shown that the injury was caused through the negligence (or the breach of a particular statutory obligation) of the third party. Examples might be a road traffic accident caused by excessive speed (negligence) or an accident at work caused by defective equipment (negligence and breach of statutory duty).
Starting a head injury compensation claim with JCP Solicitors
During your free initial consultation we will take details of the circumstances of your accident, your injuries and the resulting losses. We will consider your prospects of success and advise you on the steps to progress the claim.
We will discuss your funding options and (unless you have legal expenses insurance) we will discuss the terms of a no win/no fee agreement.
Building your head injury claim
We begin by investigating the issues of liability and obtaining evidence about the circumstances of the accident. This might be a police report into a motor accident or the report of the Health & Safety Executive into an industrial accident. Witnesses will need to be interviewed.
Supporting evidence must be obtained and the claim quantified. If the claim succeeds the usual losses that can be recovered are:-
- Pain, suffering and loss of amenity
- Earnings (past and future)
- Care and support (family care and paid care)
- Travelling expenses
- Additional transport costs
- Aids & Equipment
- Therapy (commonly occupational therapy, speech therapy and physiotherapy)
- Additional accommodation costs
- DIY & Gardening
- Money management costs
Although most acquired brain injuries settle out of court (by negotiation) we begin with the assumption that the case will be determined by a Judge after a trial. We prepare accordingly.
Although few cases reach trial it is usually necessary in catastrophic injury cases to commence court proceedings in order to fully engage with the Defendant. This is particularly so if an interim payment is needed in order to meet immediate needs. Interim payments (in cases where liability is not in issue) are essential to ensure that any requirements for the support, therapy or accommodation are met and that financial pressures do not make a difficult situation much worse.
Whatever approach is needed JCP Solicitors will make sure that the victims of acquired brain injury have the practical and emotional support that they need during the process.
